These conditions represent an agreement between you and Trufflz LLC, referred to in this document as Sass Factory. By accepting the agreement you are promising and agreeing also to follow the other rules which Sass Factory has on its website. This agreement also applies when you purchase products on Sass Factory's website; see below under “Terms of sale.” If you don't accept this agreement, you should not register as a member on Sass Factory.
It is very important that you go through the conditions in this agreement together with your parents so that you know what you can and cannot do on the Sass Factory website. Ask your parents to go through the conditions with you carefully and to help you register. When you register, activate your account and accept this agreement, you become a member. This means that you accept the conditions below and that you confirm that your parents have also read and accepted the conditions.
2. Special information for parents
Contact us at the e-mail address parentalconsent@sassfactory.com if you have not accepted this agreement and if your child has become a member of Sass Factory. We have invested in a registration process on Sass Factory's website in order to offer a safe environment and urge all parents to be actively involved in following their children's activity on the Internet.
Sass Factory is dedicated to protecting the privacy of its members and handling any personal information we obtain from our members with care and respect. The information and the terms in this agreement that we conclude with our members fulfills the high standard of protection provided for in Canada and the United States. For citizens in the US the COPPA rules apply to children under the age of 13. By reviewing our Privacy policy, you can see what information we collect from our members, what we do with it and the limited involvement of third parties. An overall principle is that we do not collect more information than is reasonably necessary for children to participate in activities on Sass Factory.
If your child is under the age of 13 and attempts to register, the account we will inform your child that parental consent is required to create their account and you will be sent an email to consent. In accordance to the COPPA regulation your consent can obtained by your taking the required action on the “Action Required: Activate your child’s Sass Factory account” e-mail you receive from us. A more detailed description of the level of activities that you will be providing consent for is presented in the “Action Required: Activate your child’s Sass Factory account” e-mail that you receive from us. Until this level of verifiable parental consent is obtained your child will only have access to publicly available features of the Sass Factory site and have no access to Sass Factory member-only content and features.

For the security of our members Sass Factory retains the right to require the identification of parents. We are not entitled to disclose other children's/members' personal data to you as a parent. Sass Factory can only disclose personal data belonging to children other than your own if a legal and/or police obligation exists to do so.
3. Personal data and Privacy policy
In order to register as a member of Sass Factory, we may ask you to provide us with the following personal data:
- first and last name,
- your e-mail address,
- your user name,
- your age/birthday
- your city, state and country of residence
By doing so, you give Sass Factory permission to use the above personal data so that Sass Factory can send out news, contests, offers and advertising to your e-mail address and so that Sass Factory can adjust the content and advertising on its website to your or others' age group and gender. Examples of the e-mail mailings are, for instance, that Sass Factory wants to notify you about new or improved services on Sass Factory, that Sass Factory is carrying out membership surveys in order to improve our services or that Sass Factory is creating targeted content and offers for you based on information about how you act on the Web site, what your age is and where you are located geographically.
Sass Factory agrees not to sell or transfer your personal data to a third party. An exception is if all or essentially all resources of the Sass Factory company, that is to say, the entire website, are acquired by another company (a so-called acquisition of assets and liabilities). In that case the personal data required in order to continue to operate Sass Factory are acquired by the buyer.
It can happen that Sass Factory comes to rely on other companies in order to carry out various tasks such as, for example, help with marketing, performing of technical services for our webpages, etc. These companies can in certain cases gain access to personal data which they need in order to complete an assignment for Sass Factory. Sass Factory treats all personal data with the greatest care and signs agreements with other companies which mean that they can only use your data in order to complete the assignment for Sass Factory.
The same applies in those cases where Sass Factory co-operates with another company to provide you with interesting offers. Such companies do not have access to your personal data other than for assisting Sass Factory with its mailings, banner marketing and the like which you have given Sass Factory permission to by this agreement. Such companies will not have the right to retain and use the data for any other purposes than the assignment for Sass Factory.
Sass Factory stores all personal data gathered from members for one year after the date when approval is revoked or membership is canceled. During this year personal data is not used and is saved only for the security of members, that is, in order to prevent, investigate, uncover and prosecute potential crimes against one of our members.
4. Questions concerning personal data and revoking approval
If you want to know what information Sass Factory has about you or have other questions about your personal data, you can contact us.
You can cancel your approval for handling and saving your personal data or receiving information and offers via email from us by filling out the form here. Please note that your Sass Factory membership will be canceled as a result.
In order to be able to offer the best possible user experience on Sass Factory, we need to be able to store personal information and data about you and communicate with you via email. This enables us to send you the most relevant Sass Factory information about sales, special offers and updates and manage your membership status. For this reason you will need to cancel your Sass Factory membership if you do not want us to access the personal data you provided.
5. Cookies
Sass Factory can place a text file in the web browser on your computer which is called a “cookie.” Like most other websites, Sass Factory uses cookies to improve and customize your experience of the website. We use cookies to track site usage statistics, such as how many visitors we have to the website and of which parts of the webpage are most popular. This type of data is never personalized to the user and we may share statistics with members, collaborative partners, sponsors, the press and others.
If you choose to deactivate the “cookie” function in your browser, you may experience the inability to register as a member or log on to the website as a member.
6. Rules of conduct
As a member you should follow Sass Factory's rules of conduct below:
• You must not swear or write things which are sexually suggestive or racist,
• You must not harass or annoy other members on Sass Factory,
• You may not reveal your real name, your password, your e-mail address, pictures of yourself or other personal information to other members. Nor may you ask other members on Sass Factory for such information,
• You must not break any laws, for example, the copyrights of others, when you visit Sass Factory nor may you encourage others to do so,
• You may not claim that you are part of Sass Factory's staff.
Sass Factory is entitled to inspect writings, pictures and other user-generated material and to remove material which
• contains advertising for other services besides Sass Factory.
• violates, or is suspected of violating, Sass Factory's general rules, among other things the rules of conduct,
• shows you or other people,
• shows personal information such as, for example, names, telephone numbers, e-mail addresses or a link to another website,
• is animated, shows comic strip figures or characters,
• represents nude pictures, pornography, weapons, pictures which are sexually suggestive or,
• represents pictures and material which are protected by copyright law and to which you do not own the copyright. Note, photographs of celebrities and comic book figures or characters are usually the property of someone else.
7. Rules and responsibilities for user-generated material
You are responsible for whatever material you create yourself and publish (upload) on to Sass Factory's webpages, for example, dolls, clothes, blogger texts, chat sessions and the like, sceneries and pictures.
Whoever violates Sass Factory's rules of conduct can be expelled as a member; for more about this (see item 10 below).
8. Rights to user-generated material
You do not own the rights to the material which you have created on Sass Factory's webpages. In this agreement you give Trufflz LLC/Sass Factory the right, without special compensation, to publish the material for an unlimited time throughout the world and irrespective of the medium used, that is, whether on the Internet, on TV or through mobile distribution, etc. This means that by creating content and designs on the Sass Factory web site, you give Trufflz LLC/Sass Factory the sole right to use, copy, present, reproduce, display, edit, integrate, license as well as distribute that material which you have created. These rights of Trufflz LLC/Sass Factory apply to both commercial and noncommercial use.
9. Rights to Sass Factory's material
You may not use Sass Factory's dolls, clothes, prints, images, information, data, names, pictures, logotypes or icons from Sass Factory's website unless it clearly states on the Sass Factory website that this is permitted. This means that you may not copy, distribute, disseminate, sell, publish, send or otherwise circulate Sass Factory's Material to another person without the written consent of Sass Factory. Nor may you change, revise or replace any of the Material found on the website, either in its entirety or parts thereof.
10. Suspension and cancellation of membership
Sass Factory has the right to cancel your membership and close your account if you violate this agreement or the regulations on Sass Factory's website or if you have not used your account for an extended period of time. We can also close your account if you fail to pay for the goods and services that you buy or if you shop without the permission of the person who is paying (see item 15 below).
When your membership is canceled, you will not be able to log into your Sass Factory account and whatever SF Cash amount that is associated with your membership account is forfeited.
Sass Factory has the right to save the personal data of a suspended member even after the account has been suspended or closed (see item 3 above).
11. Choice-of-law and jurisdiction
Subject to local mandatory law, this agreement is regulated and interpreted according to the laws in the US and the federal courts located in the state of Washington will have exclusive jurisdiction. If any part of this agreement should be considered invalid, this will not affect the validity of the remaining sections of the agreement.
12. Guarantee exclusion
Potential errors on Sass Factory's webpages are taken care of as soon as possible, but Sass Factory does not guarantee that Sass Factory's webpages always work.
Material published on Sass Factory's webpages can refer to products, programs or services no longer available in or only available in certain countries.
Sass Factory's website may contain links or references to other websites. When you use these links, you are leaving our website. Sass Factory has no control over information published on other webpages and assumes no responsibility for information and other content on other webpages. You assume the risk yourself when using other websites linked to this website.
TERMS OF SALE
13. Prices and delivery
Sass Factory has the right to determine the prices on the website itself and to change them. If certain products need to be shipped, then the shipping costs are not included in the price of the product. Shipping, taxes and all such costs are added to your bill and can be viewed when you complete your purchase.
We accept a variety of different credit cards as methods of payment.
The virtual currency in the form of SF Cash will become available to you as soon as possible. SF Cash and any virtual products (virtual clothes and all other goods and services on Sass Factory's website) may not be exchanged unless Sass Factory decides to allow for exchanges in particular cases. Sass Factory is entitled to make such decisions independently on a case-by-case basis.
14. Credit card security
We want you to feel safe and secure when you shop on SassFactory.com using your credit card. We use state-of-the-art security systems and your data is protected throughout the order process wiht the help of encryption and firewall technology. On most web browsers a small padlock is ddisplayed on the menu task bar at the bottom of the screen when you visit a secure site. Make sure you see this icon when you visit a website on which you will make monetary transactions, as you do on SassFactory.com. We also use the Secure Sockets Layer (SSL) encryption in order to protect your personal data from use by unauthorized persons.
15. Approval by the person liable for payment
Permission from the recipient of the invoice, the cardholder of the credit card used to purchase goods from SassFactory.com must be obtained before making the purchase. If you are found to make purchases without such approval, Sass Factory is entitled to cancel your membership account.
16. Returns
We accept returns for products you have purchased on the website and provided that these products along with the packaging is returned in its original condition within 14 days of the shipping date.
17. Delivery and errors
When Sass Factory cannot deliver products that have been ordered in the desired amounts, we reserve the right to supply equivalent substitute products or to remove that portion of the order which cannot be delivered. We cannot be held accountable for orders which are delayed or which cannot be delivered because of circumstances beyond Sass Factory's control (for example but not limited, natural disasters, wars, civil disturbances, the exercise of public authority, terrorism, fires, storms, floods, explosions, strikes, work stoppages and other labor conflicts, breakdowns in equipment, services or transport or other such causes).
